| In this module, students study the role of law and policy in International investment relationships. In particular, students identify and examine the relevant legal principles, underlying rationale, policy and practices applicable to international investment, the diverse contexts international investment occurs and the assumptions that underpin such legal principles, policy, practices and investment contexts. Students will assess the role of bilateral and multilateral investment treaties, the competing arguments on the efficacy of foreign investment, the definitions of foreign investment and foreign investor, the sources of the law and principles applicable to foreign investment, the impact on investment of tension between principles of public and public law, the controls available to States and the role and effect of applicable dispute settlement mechanisms.
