This module is aims to identify and examine the relevant legal principles and practices applicable to international investment, the diverse contexts international investment occurs and the assumptions that underpin such legal principles, practices and investment contexts. The module will focus on competing arguments on the role of foreign investment, the definition of foreign investment and investor, the sources of the law and principles applicable to foreign investment and the controls available to capital exporting and importing states. Moreover, students will study the role of bilateral and multilateral investment treaties as vehicles for investment and the mechanisms for the settlement of foreign investment disputes.
This course will run only if a sufficient number of students enroll.
