This module examines trust administration, trustees’ fiduciary duties, the scope of liability faced by trustees and by third-parties who have contact with trustees or trust property. It examines, in detail, express trusts, resulting trusts, traditional and new model constructive trusts, void and voidable trusts, full and half-secret trusts, and charitable or public trusts. In the second semester, the module provides an introduction to the operation of equitable remedies.

Any aspect of this module (including the weighting of the module mark’s components between continuous assessment and University scheduled written examination) may be changed in any given academic year, subject to the discretion of the module lecturer.

Note: this module is offered in other programmes under code LW351 (Equity and Trusts). Students are not permitted to register for both modules.
