This module broadly addresses the law as it relates to commerce. In particular, it concerns transactions for the sale and transfer of goods and the supply of credit entered into by commercial and business entities, including transactions involving consumers. Building on Contract Law I and II, this module addresses the legal principles relating to the ownership, possession, transfer, and sale of personal property (particularly goods), and the supply of services. The module places particular emphasis on consumer protection and the rules governing transactions between traders/service providers and consumers. The module also addresses the law relating to money and its variants (including negotiable instruments, bills of exchange, cheques, promissory notes), as well as the control of credit (particularly consumer credit and moneylending) and the rules relating to guarantees and sureties. It examines the rules concerning business partnerships and insurance contracts, and addresses and evaluates the concepts of bailment, hire purchase, leasing, and agency. The module emphasises throughout the legal implications of electronic transactions, e-commerce and distance sales. The module may also address aspects of the international sale of goods and the carriage of goods by sea.
